Protecting your personal data is a top priority for us. This notice explains which personal data is processed by Healy World Co. (“Healy,” “we,” “us”) as part of your membership as an Independent Healy World Member (IHWM).

  1. Purposes and Legal Basis for Data Processing

We process your personal data in the context of your IHWM membership for the following purposes: 

2.1. Collecting Personal Data at Membership Initiation 

To set up an IHWM membership, we collect the following personal data: 

    • First and last name
    • Date of birth
    • Gender
    • Business information (if applicable)
    • Address
    • Mobile phone number
    • Email address
    • Tax Identification Number (TIN), Social Security number, registration number (if required)
    • iPayout account details 

This data processing is necessary to establish, manage, and conclude the business relationship in compliance with our legal and contractual obligations.
Important Notice: Our services are only intended for individuals aged 18 and older. Healy does not process personal data of minors. 

2.2. Collecting Personal Data During Membership 

Throughout your membership, we process your personal data for the following purposes: 

    • Membership management
    • Order processing and delivery
    • Distribution of promotional and informational material (if you have consented)
    • Conducting trainings, webinars, and events
    • Payment processing and tax compliance
    • Adherence to legal and regulatory requirements 

These processes are conducted in compliance with legal obligations and contractual agreements with our members. 

2.3. iPayout 

For commission payments, we use the payment service provider iPayout. You, as an IHWM member, enter into a separate agreement with iPayout, which acts as an independent data controller. Healy transmits only the data necessary for payment processing to iPayout, which includes: 

    • Your full name
    • Account details (iPayout account)
    • Tax and identification data (if required) 

Additionally, Healy processes specific data related to iPayout for identity verification and fraud prevention. This is based on our legitimate interest in preventing misuse and fraud within the platform. 

2.4. Use of Healy BackOffice 

Our BackOffice, provided by Jenkon, is used for managing IHWM memberships. Data processed includes: 

    • Email address
    • Password
    • Sales and performance data
    • Transaction data 

This processing is essential to grant you access to the BackOffice and manage your IHWM activities. Jenkon processes your data solely on behalf of Healy, in compliance with all applicable data protection laws. More information can be found at Jenkon Privacy Policy. 

2.5. Use of ZOHO for Accounting 

Healy uses ZOHO for accounting and managing financial obligations, including invoicing and payment processing. We process personal data such as: 

    • Name
    • Contact information
    • Payment details
    • Transaction data 

ZOHO acts as a data processor and processes your data solely according to our instructions, ensuring appropriate data protection standards. For more details, visit ZOHO Privacy Policy. 

2.6. Data Sharing for Network and Referral Purposes 

To support your business as an Independent Healy World Member, certain personal data is shared within the IHWM network for referral and genealogy purposes. This may include: 

    • Your name
    • Contact details
    • Sales and performance statistics 

This processing fosters collaboration and business growth within the IHWM network. In addition, your first and last name, as well as your company name, are displayed in the online store when a customer enters your referral code. This allows for purchase tracking and commission calculation.  

2.7. Customer Support and Ticket Management 

For any inquiries related to general support requests or assistance with your membership, please contact our Customer Support team by submitting a ticket through our customer service portal. Healy’s Customer Support team uses the ZOHO platform to securely manage and process support tickets, allowing for efficient handling of member requests and ensuring prompt, consistent, and high-quality support. 

The processing of personal data in the context of customer support inquiries is based on Healy’s legitimate interests to provide members with necessary assistance and maintain service standards, as well as to fulfill contractual obligations related to your membership. All personal data processed through the ZOHO platform is handled in compliance with applicable data protection laws to ensure the security and confidentiality of your information. 

  1. Compliance with U.S. State Privacy Laws (e.g., CCPA, VCDPA, CPA, etc.)

In accordance with applicable U.S. state privacy laws, including but not limited to the California Consumer Privacy Act (CCPA), Virginia Consumer Data Protection Act (VCDPA), Colorado Privacy Act (CPA), and Connecticut and Utah state privacy laws, you have the following rights regarding your personal information: 

  • Right to Know: You have the right to request disclosure of the specific pieces of personal data collected about you, the categories of data collected, the sources of that data, the purposes for data collection, and the categories of third parties with whom we share your data.
  • Right to Access: You may request access to the personal data we hold about you, subject to identity verification requirements to protect your data.
  • Right to Deletion: You have the right to request deletion of your personal data, with certain exceptions, such as when the data is required for legal or contractual obligations, to complete ongoing transactions, or for internal business purposes permitted by law.
  • Right to Correction: You can request the correction of inaccurate personal data to ensure your information is accurate and up to date.
  • Right to Data Portability: You have the right to request that your personal data be provided in a structured, commonly used, and machine-readable format, which allows for easy transfer to another service provider, if technically feasible.
  • Right to Opt-Out of Sale: Healy does not sell personal information under any circumstances. We maintain this commitment in all states and jurisdictions, ensuring that your information is never shared in a way that constitutes a “sale” under U.S. privacy laws.
  • Right to Limit Processing of Sensitive Data: For certain sensitive data categories, such as precise geolocation or financial account information, you may request limits on processing to only those uses strictly necessary for the original purpose of collection. This right is granted in specific states with heightened requirements for sensitive data categories.

Third-party recipients may include hosting providers, payment processors, and logistics partners. Contracts with these third-party processors ensure your data protection rights.
